Terms and Conditions of ALESSIA YOGA


1. Scope and subject matter

Alessia Wuttke provides fee-based yoga services under the name "ALESSIA YOGA", in particular yoga in private classes, group classes, online classes (live or video recordings), yoga in workshops and retreats.


These Terms and Conditions apply to all services provided by ALESSIA YOGA. With every booking or purchase of a service from ALESSIA YOGA - whether in person, in writing or electronically (e.g. via e-mail, "Eversports", etc.) - the Terms and Conditions become part of the contract between Alessia Wuttke and the participants and are therefore legally binding. Participants are natural and/or legal persons who use the services of ALESSIA YOGA. By using one or more of ALESSIA YOGA's services, participants expressly agree to the application of these Terms and Conditions.


Amendments to these Terms and Conditions must be made in writing.


Should individual provisions of the Terms and Conditions prove to be invalid, the remaining provisions shall remain unaffected and continue to apply.


2. Personal responsibility and health requirements

A questionnaire with health questions must be completed before participating in yoga classes. Participants confirm that there are no health concerns that prevent their participation in yoga classes. ALESSIA YOGA must be informed of any existing mental or physical health restrictions, as well as any existing pregnancy, at the latest at the beginning of the respective yoga class.


Personal responsibility and normal mental and physical resilience and fitness are generally assumed for yoga classes. In the case of acute physical and mental problems, a doctor should be consulted beforehand to clarify whether yoga classes are appropriate at this time. ALESSIA YOGA must be informed immediately should a health restriction arise during the course of the yoga class.


ALESSIA YOGA reserves the right to refuse participation in yoga classes if they are of the opinion that the health requirements for participation are not met. This refusal can also be made at short notice or during ongoing yoga classes.


3. Booking/cancellation of services - Eversports platform

The booking of yoga classes (group classes, workshops) with a limited number of places as well as the booking and participation in online classes (live or video recordings) must be made via the "Eversports" platform.


To use "Eversports", a customer account must be created either via the browser (https://www.eversports.ch/s/alessia-yoga) or via the Eversports app (https://www.eversports.ch/i/z_cO0A). Creating a customer account is free of charge. The relevant provisions (membership, privacy policy, etc.) of the platform apply to the use of "Eversports" (https://www.eversports.ch/h/privacy).


Services are generally booked via the schedule calendar on the ALESSIA YOGA website (see www.alessiayoga.com/schedule) or via the Eversports app (https://www.eversports.ch/s/alessia-yoga), by selecting the desired yoga class and the product available in the customer's account (5er ABO, 10er ABO) or a single class.


The booking of online classes is due for payment immediately by credit card. The other services of ALESSIA YOGA (private/group classes, workshops etc.) can also be paid on site by TWINT, in cash, by bank transfer and, by special arrangement with ALESSIA YOGA, against invoice.


The services purchased from ALESSIA YOGA (admission for a single lesson, subscriptions or videos) are stored in the respective customer account.


Participants can find all their bookings in the respective customer account under "Buchungen". If a cancellation is necessary, the booking to be canceled can be clicked there. After scrolling down and clicking on "Von der Aktivität abmelden" with the trash can symbol, the cancellation is made and, in the event of a timely cancellation, the yoga lesson is credited back to the customer account.


The various services offered are subject to the following different conditions for registration, payment and cancellation:


3.1 Group classes in a small group

The participant must register in advance to take part in the yoga class. The number of places is limited - the principle of "first come, first serve" applies. Registrations can be made at any time in advance via the schedule calendar on the website or via the Eversports app (see section 3). Registration is binding.


The class is charged before the start of the class and the respective subscription is due for payment immediately upon completion of the purchase on site or when booking via "Eversports".


The first class (trial lesson) is free of charge.


In the case of a subscription, the 5 or 10 classes must be taken within a period of 6 months. In the event of illness, accident or pregnancy, the period can be extended by a maximum of 6 months on presentation of a medical certificate. A further extension is not possible. After expiry of the regular or any extended period, a refund for classes not taken is excluded.


After registering, participants can cancel their participation free of charge up to 24 hours before the start of the yoga class via the schedule calendar or via the Eversports app (see section 3). If a cancellation is made less than 24 hours before the yoga class, participants must pay for the class in full. If participants do not show up for the registered yoga class ("no show"), they must still pay for the class in full. In the case of a subscription, the class will be counted as taken.


Group classes will only be held if there is a minimum number of participants. ALESSIA YOGA reserves the right to cancel the yoga class if the minimum number of participants specified in advance is not reached. In this case, the costs for the class will be refunded.


Subsequent changes to the services offered (in particular to the class location) may be made at any time. Participants will be informed of such changes immediately via "Eversports", e-mail, messenger services (WhatsApp, SMS etc.), social media and/or on the ALESSIA YOGA website.


3.2 Workshops in a small group

To take part in the workshop, registration and payment of the course fees are required in advance. The number of places is limited - the principle of "first come, first serve" applies in the order in which registrations are received. Registrations can be made at any time in advance via the schedule calendar on the website or via the Eversports app (see section 3). Registration is binding. A place is only definitively reserved once payment has been received.


If payment is not made on time, the service can be refused.


After registering, participants can cancel their participation free of charge up to 8 days before the start of the course via the schedule calendar or the Eversports app (see section 3). If participants cancel later or do not show up ("no show"), the course costs cannot be refunded. This also applies if participants have to leave the workshop early for any reason.


Workshops are only held if there is a minimum number of participants. ALESSIA YOGA reserves the right to cancel the workshop if the predetermined minimum number of participants is not reached. In this case, the costs for the classes will be refunded.


Subsequent changes to the services offered (in particular to the class location) may be made at any time. Participants will be informed of such changes immediately via "Eversports", e-mail, messenger services (WhatsApp, SMS etc.), social media and/or on the ALESSIA YOGA website.


3.3 Public group classes

No prior registration is required for participation in yoga classes.


The class is charged before the start of the class and the respective subscription is due for payment immediately upon completion of the purchase on site.


In the case of a subscription, the 5 or 10 classes must be taken within a period of 6 months. In the event of illness, accident or pregnancy, the period can be extended by a maximum of 6 months on presentation of a medical certificate. A further extension is not possible. After expiry of the regular or any extended period, a refund for classes not taken is excluded.


Subsequent changes to the services offered (in particular to the class location) may be made at any time. Participants will be informed of such changes immediately via "Eversports", e-mail, messenger services (WhatsApp, SMS etc.), social media and/or on the ALESSIA YOGA website.


3.4 Online: Group classes & videos on demand

Prior registration is required for participation in online classes. Registrations can be made at any time in advance via the schedule calendar on the website or via the Eversports app (see section 3). Registration is binding.


The class is charged before the start of the class and the respective subscription is due for payment immediately upon completion of the purchase or when booking via the Eversports app. Payment must be made by credit card.


Access to the online classes or videos is via the customer account on "Eversports". Under "Buchungen" in the selected online class, the link to the class will be visible as a button for registered participants 15 minutes before the start of the class. An email with the direct link will also be sent to registered participants via "Eversports" 15 minutes before the start of the online class.


The online classes take place on Zoom.


In the case of a subscription, the 5 or 10 classes must be taken within a period of 6 months. If a cancellation is made less than 1 minute before the yoga class, participants must pay for the class in full. If registered participants do not take part in the online class ("no show"), the class costs will not be refunded. In the case of a subscription, the class will be counted as taken.


3.5 Private classes (on site or online)

Interested persons can contact ALESSIA YOGA via e-mail or messenger services (WhatsApp, SMS) to arrange a free appointment. The needs will be clarified during the appointment.


Appointments for private classes are arranged individually for each class and entered by ALESSIA YOGA on Eversports as a set date.


The class is charged before the start of the class and the respective subscription is due for payment immediately upon conclusion of the purchase.


Private classes can be canceled free of charge up to 24 hours before the start of the class via the schedule calendar or via the Eversports app (see section 3). If a cancellation is made less than 24 hours before the yoga class, 50% of the class will be charged. If a cancellation is made less than 12 hours before the yoga class or if participants do not show up for the agreed yoga class ("no show"), the class must be paid for in full. In the case of a subscription, the class will be counted as taken.


In the case of a subscription, the 5 or 10 classes must be taken within a period of 6 months. In the event of illness, accident or pregnancy, the period can be extended by a maximum of 6 months on presentation of a medical certificate. A further extension is not possible. After expiry of the regular or any extended period, a refund for classes not taken is excluded.


Online private classes are generally held on Zoom, subject to individual agreements.

4. Liability

ALESSIA YOGA assumes liability for the proper conduct of the classes within the scope of the statutory warranty. Any further liability is expressly excluded. In particular, no liability is assumed if participants have concealed any relevant physical or psychological ailments.


Participants use the ALESSIA YOGA classrooms and offers at their own risk. No liability is assumed for valuables brought by participants. Insurance (against theft and damage to property as well as health and accident insurance) is in any case the responsibility of the participants.


5. Privacy policy

The regulations in ALESSIA YOGA's privacy policy, which can be accessed at any time on the website www.alessiayoga.com, apply to the processing of personal data.


6. Copyright

The copyright and all other rights to content, images, photos or other files on the ALESSIA YOGA website belong exclusively to Alessia Wuttke or any specifically named rights holders. The written consent of the copyright holder must be obtained in advance for the reproduction of any elements.


7. Jurisdiction

Subject to any mandatory statutory provisions to the contrary, the ordinary courts of the Canton of Basel-Stadt shall have jurisdiction. Swiss law shall apply exclusively.


8. Final clauses

ALESSIA YOGA reserves the right to amend these Terms and Conditions at any time. Changes will be made available on the website and will come into effect immediately upon publication on the ALESSIA YOGA website.
